A Cyclist lost his case for damages in Dublin Circuit Civil Court recently conceding that it was wrong of him to cycle on the footpath when there was a cycle lane available to him. Derek Quinn was cycling along the footpath to avoid having to cross the road when he was struck by a vehicle exiting a driveway “at less than a walking pace”. No evidence of negligence was found against the driver of the car and it was accepted that he had done everything that he could. Judge Martina Baxter ordered the Plaintiff Cyclist to pay all costs.
